Dale Earnhardt Jr. is no longer with the company and has left the building

I had no intention of writing anything for the Observer about thiswhole business about there not being any Dale Earnhardt Jr. memorabiliawhen the NASCAR Sprint Media Tour sponsored by Lowe's Motor Speedwaywent to visit Dale Earnhardt Inc. last week.

When the whole thing came up, my reaction was, "Well, duh."

Now I see a wire story about this overblown nothingness has found itsway to the pages of thatsracin.com. So I guess I will say somethingabout it after all.

Well, duh.

In case you guys missed it, Dale Earnhardt Jr. doesn't work at DEI anymore. There is no more Budweiser No. 8 car. Budweiser is sponsoring another car, the No. 9 Dodges driven by Kasey Kahne, and Earnhardt Jr.has a new employer, Hendrick Motorsports; a new car number, No. 88, and new sponsors in AMP Energy Drink and the National Guard.

Honestly. All of that has been in the paper and everything.

Does anybody really, honestly, expect DEI to build its displays of the history of its team around a guy who took a powder and headed down thehighway?

When the 250 or so people on the media tour rolled into DEI, the good folks there served us lunch. To do that, they set up dozens of tables on the floor of the main showroom in the public area of the DEI headquarters. They also set up a stage for DEI's principle figures to stand on and another riser for television cameras to roost during theprogram.

To do all of that, they had to take out a bunch of cars that are left on display to show the team's history. DEI president Max Siegel told Jenna Fryer of The Associated Press that among them were several cars that Earnhardt Jr. had driven in Busch and Cup competition for DEI.

It doesn't really matter to me if those cars were there or not. I do know that if we'd rolled in there and walked past a half-dozen display cases full of memorabilia featuring Earnhardt Jr., there would have been those criticizing DEI for continuing to try to make hay off a driver who's no longer there.

Some people actually were surprised there was no Earnhardt Jr. souvenirs or memorabilia for sale in the gift shop. Good grief, folks, a bus load of lawyers racked up the billable hours determining every aspect of who could sell what as DEI, Earnhardt Jr. and the various sponsors all parted ways.

DEI no longer has rights to sell Earnhardt Jr.'s stuff and Budweiser doesn't want people selling No. 8 shirts and hats when it's paying to put its colors on the No. 9 now.

That's ridiculous.

The displays around DEI feature a lot of stuff relating to the man who founded the place, Dale Earnahrdt Sr. One of the rallying points for the people who still work there is that they're still trying to sustain the legacy of a seven-time champion who helped build that company to the point where it could field Cup cars and, when the time came, be strong enough to keep going in the face of Earnhardt Jr.'s departure.

Earnhardt Jr. has turned a page. He's doing what he feels he has to do to have the best shot to win races and championships. DEI, meanwhile, is trying to go forward, too.

Mark Martin and Aric Almirola will share theNo. 8 Chevrolets this year with the U.S. Army as its sponsor.

It's a new chapter for DEI, too. Yes, there's probably a little bit of hurt reflected in the fact that some of the stuff Earnhardt Jr. accomplished at DEI isn't more prominently displayed right now.

You could argue that by not showing that off DEI isn't giving proper tribute to the people who're still there who helped Earnhardt Jr. accomplish that. At the same time, maybe some of those people who didn't leave when Earnhardt Jr. chose to are staying at DEI for the expressed purpose of making new history and ringing up new accomplishments.

Maybe they'd rather not, at least right now, be reminded of what for most everyone involved was an emotional parting ofthe ways. Yes, the Busch championships and 17 Cup victories, inclulding a Daytona 500, that Earnhardt Jr. racked up are part of the history ofDEI.

Absolutely that should be part of any retelling of the company's history. But isn't it possible to understand why, with all the wounds ofthat parting still so fresh, there might be a bit of pettiness involved in how the trophies are arrayed in the cases at DEI?

Well, duh.

Thank you for NOT being on the "BASH Teresa and DEI Bandwagon".Dale jr stuff is in the same spot as the NAPA 16 Truck Championship stuff and Michaels 2 Daytona 500 Trophies. Fond Memories. We enjoy it everyday when we walk by the showroom which proudly displays their cars and trucks.

Well, duh. DEI slipped you some of that kool-aid, I guess! I shouldn't be surprised. You've never really "gotten it" when it comes to Nascar fans. The passion they have, the intensity that they possess. You talk to them like they are three.

Well, duh.

Considering you just get to sit on your backside writing out your opinions and telling people how to think and feel, it is easy to talk down to folks. You obviously make enough money to think that you can continually speak from, well, your backside.

So, duh sir, can your ingenious, insightful, so "gets it" mind explain why Seigel never, you know, answered that media question? Only after the uproar does he give the same reason you just gave? So, you, instead, tell people they're stupid in two simple words: "Well, duh."

Well, duh. How do you expect people to react? Do you expect them to just think all is hunky dorry? Maybe if Max had out right said, "We're setting up for lunch, some things had to be moved out." folks probably would've been OK with that. Well, duh.

Of course, how about the son of the man who built this place has some legacy here too? Of course we all know he's moved on, he's out of the building. But then perhaps you should tell Hendrick that all his drivers are gone. Perhaps you should tell Gibbs, Bobby packed up and left. What was that? Powder and a highway? Maybe you should tell Richard Childress, and I hope I'm forgiven for this, but maybe you should tell Richard Childress and DEI that the man that brought them everything is dead. Why are you continuing his legacy? I mean, nevermind what he DID for the companies. What any of these men did for their companies. I mean, duh. That has nothing to do with it.

Mr. Poole, there are a LOT of mean things I'd like to say to you. It would be quite easy to insult you. But you see, unlike you, I don't think I'm above you. I just believe that something should have been focused on Junior. After all, he gave them two Busch championships and a Daytona 500 win. What else has that company got? Oh, right, just Martin Truex's two Busch cham... wait, that was with Junior's Chance 2. Does that count? So basically just his one win. Did they ask Roush to get rid of Mark's stuff and send it on over? And was everything of theirs, you know, not displayed? Quite frankly my dear sir, why don't you get in touch with your readers instead of insulting them. And maybe you should think like Junior. Does he care? No, but he's upset that these things where gone that his team helped get him.

Oh, by the way, after eight years in the same building, doing the same media routine, do you think Junior would've known that they had to get rid of just his stuff for lunch?

Some of Juniors fans are so head strong about the driver they can't see the forest for the trees.

Jr owns his rights to his own body, name and such and being as that is, maybe he is not allowing the use of his likeness even for DEI at this point and time.

People are making mountains out of mole hills and the media is blame. What better marketing play than to piss the Jr lovers off so they will buy more new stuff and feel they are sticking it to Teresa at DEI.

Time will tell what happens in this DEI/Jr love affair.

Junior has his reasons for leaving. Anyone ever think it was to help DEI be better rather than make it sink. Come on people it is his fathers company. Those that don't understand corporate dealings would be surprised what someone will do to make a company succeed.

It is time Junior grew up and became a man and show us what he is really like as a driver instead of riding on his daddy's name!!!

Lets see how he likes towing the line with the Hendricks team and being MR PC all the time. No more partying at Whiskey River and underaged girlfriends on the pit boxes much less in the motor coaches. Juniors playboy days are over.

As for DEI, they will survie and Teresa is not going to be singing "if i could turn back time" were JR is concerned.

Sr knew what he was doing when he did not leave the company to the kids in his will. Smart man that SR...

Perhaps you should talk to your legislators. It is actually impossible to leave things to your children without being taxed more than you make. (Or that's how it feels at least.) You do know of that tax, right? It's a federal tax. Senior did not leave it to his wife because he didn't want his children to have the piece of the pie that ALL parents try to make for their children. He did it because it was financially impossible to do otherwise.

Well, duh.

I guess Senior's close and personal friend, Darrell Waltrip, was lying when he said senior told him you build the future for your children. I mean, us common folk? We so know so much more than the drivers that were his friends.

David; I guess you can see how passionate some NASCAR fans are, especially Dale Earnhardt Jr fans. It would have been nice for Max Segal to be honest with the media right away instead of not answering at all. I'm glad to read from a DEI employee that stuff from Ron Hornaday and Michael Waltrip are still around. Maybe it's time for DEI to build a standalone museum for DEI memorabilia. David, try listening to the fans instead of just DEI. Thankyou for the info about why they moved the items. But did they have to move Dale Jr's only?

it is not about the tax implications, which I am well aware of, it is about being responsible enough to handle it.

i am sure sr wanted to build a future for his kids,what parent doesn't, but they also needed to earn it just like he did.

sr could have made provisions for them and the comapny had he chosen for the future. He did not for reasons known only to him.

I will stand my ground on this that Sr knew what he was doing and smart enough to do it..

Very simply, if Max had said the cars were moved the day it was asked, it would've been a non-issue. It didn't occur to you that maybe the "clarification" wasn't big time back-pedling?

Also for those that say they cant sell his stuff anymore. Why was his stuff removed the week after Homestead? I went there to get some stuff for my dad and it was all removed. I understand that the 1st of the year they couldnt sell it but a week after the season?

And let's be honest...Why would Max Seigal make comments this week to CLARIFY why there was no Dale Jr. memorabilia in the showroom? Furthermore, how could over 50 media reporters notice the same thing and write stories RE: DEI and the lack of Dale Jr. history in the showroom?

You don't get it....

Only a smart step-son would leave the building when he knows that he is been given the "shaft". No one works their a-s off and gives their life's blood to someone who has no love for that person and is in it strictly for the money. He did not take a "powder" as you put it he let the world of NASCAR know his every move and still protected the DEI name, because he so loved the man who started the business.
If you watched the DVD "Dale" when he was so causaly fishing and was asked "Why did start DEI and not just remain a driver?" His reply was "So that my family and childrn could carry on his name some day"

The only thing Dale Sr. didn't expect was his life was so short lived and he is not here today to defend his namesake, who he loved so very much.

And yes I am a loyal Junior fan, but I was also a loyal fan of his father.

It never ceases to amaze me how long you have been a writer around this sport yet how little you know about its business workings.

DEI can sell whatever it wants.

They no longer have the assigned legal right to license anything that uses the name or likeness of Dale Jr. Do you think Toys R Us has a license with every team to sell NASCAR goods?

The question is; why wouldn't they sell Jr goods? Do they feel the exposure they would be giving Jr. is not equitable with their treatment of current sponsors and drivers? Or is it a statement about something else.

I am not a fan of Dale Jr but I am a lifetime fan of NASCAR. When you visit the Hendrick (I'm not a Hendrick fan either) display there is a tip of the hat to every driver who got them where they are so maybe it's just a statement about class. Based on that, I'd say Jr made a good change.

Jr once said that his realtionship with Teresa has been the same since he was 8 years old. That can be taken two ways. Right now it looks like one child punishing another by leaving with all the toys.

I don't dislike Jr., but frankly I am growing very tired of the daily stories written about him. There are other drivers and other fans in this sport. Granted maybe he deserved more than what he got,Sr. should have seen to it, he did not. There is nothing nobody can do about it now. LET IT GO. In the end she will fail.

You say she is keeping the Legacy of Dale Senior to the fore front. Indeed Dale Senior and Teresa built DEI. Do you remember that redheaded step child that won 2 Busch Championship and made his father so proud. Do you remember that racer that placed 17 cups wins in DEI" history books?
Evediently not. According to you he took a "powder" and went off down the road to better himself. Shame on him for finally doing something for himself!
Dale Junior wants DEI to survive and so do I for HIS and his siblings sake, not Ms Earnhardts.
Dale Senior's heirs, and I mean all of them deserve to see their father's dreams achieved. I think the split is the best thing that could happen to both.

Speedway Goddess -- As a matter of fact, I did not eat lunch that day. I just didn't care for the food they served. The reason the lunch was relevant, you see, is that to accommodate the media they had to move out a major portion of their displays, which included cars that were driven by Dale Jr.

I will make a deal with every person who mentioned my weight. Let me concede the point that I am a fat slob. I am a mess. Couldn't be more of a pig. You completely win on that point. OK, now, let's pretend I weighed 170 pounds and looked like Biff Studley. How would that change the actual merits of the points I make one way or the other one bit?

If any of you cared to check, I think you would find that for more than a year now I have managed to cover this entire controversy and maintain the respect of key players on both sides of the equation. My job is to be fair to everybody. It's not to report what 50 other people are reporting if, based on my view of things, what they're reporting misrepresents facts. And to be fair to Jenna Fryer, her story does explore both sides of this particular issue. She took the time to check with Max and get an explanation. Max wasn't back-pedaling. He answered the question when he was asked it. Dale Jr. was asked about this last week at the Hendrick media tour stop and didn't take the bait. They hit him with it again at Vegas yesterday and, for the most part, he again didn't take the bait. Some people took one criticism he did level and built a story around. Those people did that precisely to get the exact reaction you see in the comments to this blog. If that's how they want to do their jobs, that's up to them. -- David Poole

From what I have heard since this broke there is some sort of Jr and Mikey memorabilia there before the press arrived but was gone when they were present. So was it a planned event to bring attention to them? Or was ALL memorabilia gone? Seems wierd that just the Jr memorabilia was removed ...

I am a Jr and Mikey fan but do know the workings of politics .. in all life events. So someone tell me that ONLY Jr's stuff was gone but everyone else was there ... or move on ...

As has been mentioned many times by drivers, other garages, other owners, Rick Hendrick is a class act. He included Kyle Bush and his accomplishments while at HMS. Kyle certainly did not contribute as much to HMS as Jr did to DEI.

I do not think that Teresa should have just turned over DEI to Jr. She was a co-founder. It wasn't like she was a stay at home wife. She worked very hard to make DEI successful while Sr was racing.

But she is a very small person. She could certainly shown some grace. First denying him the #8. That # was only valuable if Jr had it. There is no way in G_d's green earth they will even get 5% of what it got before.

On more that one occasion Jr asked the press and fans to take it easy on Teresa. He did not want to fan the flames of hatred. Even when it has been obvious how happy he is at HMS, he has said that in no way did he want it to be a reflection on the guys he worked with before.

I was never a fan on Jr's until he left DEI and saw how he handled himself with grace and class. I think Kyle Bush finally took a page from Jr's book. After a few weeks after he left HMS, he finally quit acting so bitter.

Teresa needs to get some strong people around her to tell her when enough is enough.

It never ceases to amaze me how (to use your phrase) someone, like you, can be so misinformed as to make a complete and utter ass of themselves in public.

Earnhardt Jr. told NASCAR.com that on Friday night, he and his stepmother, Teresa Earnhardt, agreed to terms to legally transfer rights to his name back to him. Terms of the deal were not disclosed by the Web site.

Now after knee-jeking yourself into a foolish grin by noting the authors alleged ignorance on that matter you should apologize.

And in case you have reading comprehension skills that are far below normal, DEI has zero rights to anything connected to Dale Jr's name as of June 2006.

I am so sick and tired of all of the whining about this. I agree 100% with what David said in this blog. I just dont see how the placement of trophies is that big of a deal. Jr. is not at DEI anymore because he is a spoiled brat. I am truly tired of the most overrated driver in the history of NASCAR getting the most news coverage for every tiny thing that he does or even doesn't do. I guess they can't really talk about his recent victories...since there haven't been any for a really long time. Look at the facts and quite simply...grow up. He isn't with the team anymore and that is that.

Even as a Jr fan, I feel it is overboard, but I do not understand how that makes him an overrated racer and a spoiled brat. The guy works as hard as the next driver and his wins and championships speak for themselves. David pretty much just reported and threw in a pinch of opinion. No need for Jr fans to jump off the deep end. For those who are fixated with David's girth, he has been known to turn down a meal. I invited him for Kansas City Barbecue and he turned it down.

Its not going to make a lick of difference to the wild-eyed fanatics of the Cult of Earnhardt, but its nice to know that at least one reporter can report rather than instigate.

This whole thing reminds some of us of that sly, gossipy, untrustworthy girl who first whispers to Brittany, "Did you hear what Ashley said about you?" then scurries off to Ashley, "Did you hear what Brittany said about you?"

How about a breaking story on the quanity and prominence of Kurt Busch items at Roush? ;)

Our family toured DEI, and RCR last Spring. We were surprised that RCR had as much Junior as DEI. Most companies are displaying their history, and not their present or future. If this was not a family matter Junior's stuff would be on display. If, Jr.'s fans want to see a good #3 display go to RCR. What is displayed at DEI is very weak. The place has already become a Museum. Like MM it is trading on its past. Gone are the good ole days here. Just Mother T. and her memories.

I am an old NASCAR fan and realize that you are the receipient of a bunch of slamming of your opinions here and although I disagree with most of them I think that DEI should keep all the Dale Jr. memorabilia and display it prominently and proudly as it is as much a part of the DEI history as Dale Sr.'s own is. Am I a Dale Jr. fan? No. But I am a NASCAR fan and my like and dislikes are not the issue, my being a NASCAR fan is. I don't care who sponsors a driver, who sells the memorabilia, And who hates who. I want to see racing. There is an old saying that I believe an old army general said back during the Civil war era. " My legacy will be made by the persons that follow me in subsuquent generations, but I believe in, and will display my accomplishments now, here in my lifetime", or words to that effect. Maybe we can learn from this statement. So lets get to Daytona, see some high quality racing, and may everyone's favorite driver win this season. GO NASCAR - GO TOYOTA - GO FORD - Go DODGE - GO CHEVROLET... etc. etc. etc.

Seriously this train wreck should have wrapped up last year. Two weeks after Jr signed at Hendrick this should have become a non-issue.

Instead this has become NA$CAR's own Brittney saga.

Sunday I was driving home from my cottage, tuned into NA$CAR on Sirius and was looking forward to 5 hours of racing talk. Instead it was a Theresa witch hunt and I turned it off.

If NA$CAR coverage remains the same this year I will be turning more off for sure!

It took more than one last name to build NA$CAR. Perhaps someone will sit young Mr France and the executive team that.

As mentioned by some people who actually can think, Dale Jr. has moved on -- as a fan of Jr's, I too was sorry that they couldn't work out some sort of deal with Teresa BUT the long and the short of it is this: they couldn't, Jr. took the high road, did what was best for HIM and not for others, and is now happily ensconced at HMS. That being said, I wouldn't be surprised if down the road certain things happen and Jr. returns to DEI. Teresa chose to take the low road and has to suffer the consequences from 'not thinking the entire thing through'. We should all be happy for Jr. and support him no matter where he drives. Trust me, someday he'll be back at DEI at some level -- meanwhile, I thank Mr. Poole for his article and trust that the history of DEI will be replaced now that the media frenzy is over - after all, any type of history consists of many people doing many things, regardless if they are still involved with that history or not. I am sure Teresa has this one figured out!

You have your heads so far up your ass you think there is a conspiracy in everything involving Jr. and Teresa. If you read the (multiple) stories out there you'll see that when Siegel was asked about the cars being moved he answered the question immediately. There was no need to address it beforehand, none whatsoever. My God it's people like you that make it difficult for me to defend my interest in Nascar to some of my own friends! You're more upset about stuff like this than (I'm willing to bet) more important things within your own community or even country that matter! Get a life. Jr. is gone from DEI. Yes he had a tremendous part in that and his legacy will be honored in some way there. That doesn't mean they have to keep his cars out on display (which apparently they will once they move them back). I'm also amazed at how many of you know more that the dei employee who posted here. That's really incredible seeing as he/she spends a lot more time there than any of you do. Also, based on your hatred for Teresa why do you even care if Jr's cars are or are not on display? I think you're right on target, David. Considering the circumstances that Jr. left under, I believe the best thing for everyone involved is to respect and remember the past, but move forward and get on with the new season. I don't believe the best way for DEI to move forward is by having its employees walk by a shrine to Jr every morning as they prepare to work. They need to focus on the new season, and be excited about the drivers who represent the team now.

I'm not Teresa's biggest fan, but this whole deal is just a non-issue. Get over it, people...

Notice that JR had no problem with it a week ago . Then his sister pushed him into making it a big production . Kelley will not allow one day to go by without JR in the news .
The DEI employees ( and not just Siegal ) say that the JRs cars and other items are right there where they always were . The incredibly obtuse Jenna Fryer got it wrong again . She should stick to writing about something she knows , as soon as that comes along . But this should be a lesson , when Fryer writes anything , be very skeptical .

You repeated exactly what I said and missed the point entirely. I clearly said DEI no longer has the right to Dale Jr's name or likeness. This means they cannot CREATE NEW PRODUCT in the future. ANYONE can RETAIL goods already manufactured under previous agreements.

When your Mommy takes you to Toys R US, don't you see older vehicles with drivers who are no longer together? In the contract there is a 90 day sell-off period for the manufacturers to sell their existing goods to retailers but retailers can sell whatever is available as along as they want.

Doesn't my screen name give you a clue that I might know more about toys than you do? I am a licensee of DEI and even if I hadn't seen the contract this has been the standard licensed goods practice since the beginning of time. Yes, I expect Mr. Poole to know about something before he makes an erroneous sweeping statement as if it is fact.

You have to learn some manners before you sit at the table with us adults.

ToyPHD, I assure you that I understand far more about the business of NASCAR than you give me credit for. There are aspects of the split between DEI and Dale Jr. that are unique to that and different from virtually every other licensing deal that's ever been signed. I don't know that DEI can or can't sell merchandise it might have had on hand, but I would renew the point that if it should do so it would no doubt draw criticism from some fans for trying to make money on Dale Jr. after he's gone. It also makes no sense from a marketing standpoint for them to sell merchandise for a driver they no longer employ.

Anon, I don't know why NASCAR fans think that NASCAR is somehow special, different or excluded from the world of standard business practices. Again, I have seen the portions of the agreement as it pertains specifically to rights, assigend rights and the flow termination procedures.

The only point I am making is that DEI can retail goods with Jr's likeness on them. Whether it is exsiting goods, new goods manufcatuered under the old agremeent or even the new goods being licensed through HMS. Heck, they can even retail Ward Burton goods if they wanted.

I am not a fan of Jr so I could care less what they do but the contract does not preclude them from retailing anything. It's their choice.

One school of thought is that selling Jr in the #8 Bud car somehow gives he and Bud publicity. Which, given the potential number of cars they could sell, absurd. Another school of thought might be fans come to the shop to get closer to something they love; Dale, Dale Jr. and DEI.

We will never know exactly what transpired in this situation but from a Marketing professional's point of view; why tick off the few thousnad fans who would actually visit the shop and buy a car?

Let's be even more honest, would you agree that most of Dale Jr's fans started out by being fans of his Father, right? So why publicly force fans to make a choice between DEI and Dale Jr?

This whole situation sadly reflects the major differences in business philosphy between DEI and Hendrick Motor Sports. I am a JR fan,but this is just plain crazy. Yes JR won 17 times for DEI and 2 Busch championships. JR is now moved on doing what he needs to do. If DEI want to take all of his stuff and burn it then that's there right.I don't like it but they have parted ways and that is that.As for all of the comments about Mr.Poole what he said is his opinion just like what everyone else is saying is theirs.I hope both JR and DEI do good just because I am an Earnhardt fan.

Please take the time to review a few legal facts before you state "they can sell older Jr things".

Ok Bud is with the 9 car and Jr is with yeah HMS.So why would HMS or Bud allow DEI to sell anything resembling the 8 or the BUD log? Makes no sense.

Some think its a lovely idea, but it is not happening in NASCAR now.I am sure those whom hate Teresa will say it is her fault, but in all reality its no ones .It called a business now..

Mr. Poole, oh how you love to anger Junior nation. But are you on the DEI payroll? Well duh, reading this post indicates you are.

The saddest thing about this whole story line is the failure of family and the jealousy of one, crazed woman who obviously harbors a hatred for Sr's off-spring.

Well, eventually, those that turn their backs on family deserve to fail and DEI will fail. Oh DEI will most likely always be in NASCAR, but they will never be as popular or profitable as they were under the SR and JR umbrella. Sure, they brought in Mark Martin, the good ol' boy of NASCAR, because no one would boo Martin, right? Wrong. Go to a live event, not watching it on TV and see how NASCAR fans feel about DEI and Mark Martin's betrayal of the Earnhardt name.

The move by Mark changed my view of him. Instead of the respect I once had for him I now reserve for wishing him failure as well. He, of all people, should have known what SR's company meant to JR. That was his father's company and I'm pretty damn sure that SR wanted JR to take over the reins when SR retired. It was a betrayal only second to Theresa's betrayal of JR.

As for Truex, he is a puppet of Theresa's and will do what she asks. "dance little puppet dance"

I wish nothing but failure for DEI, based on the fact Theresa turned her back on family, on the Earnhardt's, the true blood Earnhardt's, not the I married into the family. So for that, I raise my glass to toast the failure of DEI. Hooyah..

To those who just chalk this up to business, well, we see what all business in motorsports is like, just look at the IRL. Here's a thought, perhaps DEI should hire Gene Simmons to market its products. He has done wonders for the IRL series.

I'm sad for JR because of the betrayal he must have felt concerning his departure and his legacy at DEI. And Mr. Poole, there are lawyers out there who could have kept JR's legacy there without compromising sponsorship obligations. EASPORTS has done it in their racing games, why not employ that at DEI? Oh wait, it because Theresa doesn't want to have anything to do with JR or his family. She is content to remove the Earnhardt name from DEI, while still making huge profits off SR.

SR fans, you want to send a message to DEI, stop buying their merchandise and that includes 3 related items. The only way to send a message to business owners is to hit them in their pocket books. Stop buying their stuff and watch them fail.

As for JR and his sister, I am so glad to see that they stuck together as a family unit, something that is missing in society these days, and came out better on the receiving end than their step-mother did.

Last but not least, I would love to see JR motorsports buy out DEI in the next five years or so. That would be something. The ultimate in don't mess with my family, bitch.

I am a Junior fan. I just finished reading the 63 posts before mine that have been posted in less than 24 hours. It seems as though its running at least 5-1 against David Poole.

And the large majority of those against what David wrote? Probably the most embarrassing tripe I have ever read on this (or any) this blog. For all those who took could only manner to muster up personal attacks on David's weight... shame on you. It is YOU that make the rest of those of us in Junior nation look bad. It is YOU that cause people to view all NASCAR fans as a bunch of uneducated bunch of inbred, toothless alcoholic tobacco chewing bubbas.

You people have never even met Mr Poole or Ms Earnhardt, yet you are quick to ASSume that you know what is going on. You 'think' - and I use that term loosely - that you know what Dale Sr wanted and presume to know what he would be thinking from beyond the grave. Well, folks, guess what... you don't. He and Teresa - as husband and wife - made a decision that if he dies, the company goes to Teresa. If she died, it goes to him. And look at yourselves... if you were to write a will, you would leave all of your assets to your spouse first. Dale Sr loved her, and she loved him... show some respect. I don't presume to know what he would say from beyond the grave, but as a married man who loves his wife, I could only imagine how angry I would be if people spoke of my wife the way you speak of his.

Again, shame on you. The ultimate sign of respect you can show Dale Sr is to leave Teresa - and Dale Jr - alone. It is what it is, accept it and show some class.

And, for the record, because I refuse to get on the Theresa/DEI/Davis Poole bashing, I will say this - I have met none of the above nor am I on anybody's payroll.

Not only is Dale Jr. the SON of the founder, he was a Busch championship driver AND won several Cup races, including the prestigious Daytona 500. No one expected merchandise to be on sale - that would be absurd. Have his cars parked on the premises is hardly recognition to Dale Jr. - so don't pat yourself on the back for that Max Siegel. Hendrick Motorsports honors its past and present drivers in its shop -- as is the case with all GREAT COMPANIES. There are former president pictures in the white house; there are former president photos in the halls of today's Fortune 1000 companies. That my friends is class.........

NASCAR fans can be passionate people, but c'mon - show some class. I love how some of them think they have the inside know on everything - on Jr.'s or Teresa's intentions. If you ask me, if he heard the vile that people spread around about his beloved wife, I think he would be looking to kick their ass.

I can assume, because that is all we can do is assume, Martin felt empathy for JR, in the fashion of a father figure, which is why he probably felt compelled to help JR in his transition with HMS. But that does not factor into my point. The point was DEI, hence their CEO, turned its back on the founder's son. Family doesn't do that to each other and if they do they get what they deserve.

In my opinion, Martin was brought into the fold because he sold JR out by accepting his old ride. A veteran and respected driver should know these family values, yet he went against it in order to drive for another damn year. It is greedy and a move made strictly for more money. How much money is enough? We all say NASCAR is deeply rooted in family values and a good ol'boy sport. Does this sound like a family values and good ol'boy move? No.

Martin's helping hand to JR during the transition to HMS was done more out of respect for JR and his father. I don't deny that or argue against that point. Moreover, I support what Martin did. However, Martin disrespected NASCAR by going against its family values in driving for DEI. I don't feel JR's ride at DEI should have been replaced with someone who has raced with SR and JR, and thus is a veteran of the sport. If DEI wanted to start a new chapter, as they claim to want to do, why did they choose Martin? Why didn't they bring up a no name in Busch or IRL to take the ride, and create a legacy for that driver? It is because DEI knew they would catch hell for this move at removing JR. They assumed that by hiring Martin, who raced against SR, that would calm the uprising based on the amount of respect most NASCAR fans have for Martin.
Perhaps this is why NASCAR isn't what it once was. It is being ruled by the all mighty dollar now, instead of what should matter, family loyalty. You don't see the Petty's getting rid of Kyle. Why? Because it is a family business.

Granted, I wasn't there during the discussions to keep JR at DEI, had I been, JR might still be with DEI.

I bet DEI sees a 90% drop in visits to the Gragemahal; I know I will never return. I'm also fairly certain that Sr. would have given Jr. 51% of DEI when he asked for it last season. Like Stewrat said, it's just a museum without Jr. I bet Truex Jr. leaves for another team after 2008. Jr is a class act - and while he may have no hard feelings, I most certainly do. DEI could have bought a great deal of good will if they hadn't put-forth that ridicilous request for 50% of all #8 sales, in order for Jr. to take HIS Grandfather's number with him to HMS. I respect Teresa, but she made some bad decisions in 2007 (I have recounted only 2 of them above) and DEI will pay for those bad decisions henceforth. Every garage should honor all of their previous drivers - the way they do at all garages, save for DEI. It is unfortunate and regretable, but will have no effect on Jr's pending rise to certified greatness. DEI will regret not giving him what he wanted - you can chisel that in stone.

DEI will regret not giving Jr. what he wanted because DEI will decline while Jr. soars. Beware the 88. Kelly is with Jr., and would have and will be fine. Teresa and Taylor would be fine with 49% (of DEI with JR. - no one will be able to live on any % of DEI w/o Jr. Beware the 88. T does not owe Jr. a shrine, but DEI owes Jr. the same level of display that Kurt has at Roush - pictures and memorabelia of his accomplishments as a valued (and loved) employee at DEI. The purge was a calculated swipe - and when they see 10% (in 2008) of the fan traffic they enjoyed in 2007 - they will regret the swipe. JACK MAKES MONEY, thats a good business decision.

Thanks Kurt2 - I appreciate the education. However, when I mentioned Roush/Kurt, it was not in regard to a business decision or to sales, etc. It was in response to your question about what a former driver is owed. Common courtesy was my response.

Now, Kerry and all the other Earnhardt/Eury/etc., etc. folks would have been fine with Junior as majority owner - they very likely would have been better-off than they are now - because DEI has now lost half (conservatively) of it's value (measured in future earnings, etc.) and I'm fairly certain that Jr. would treat them as well as Teresa.

They all will likely be working for JR Motorsports in 5 to 10 years when DEI (sadly) folds. I hope I am 100% WRONG about that but I do think that DEI lost 50% of it's value the day junior walked away.

I'm probably wrong, as you have stated that Kurt left Roush because he wasn't getting his fair share of the t-shirt sales, but I thought he left because Roush fired him - because he was such an ass that nobody at Roush could get along with him????

I won't twist anything, as I said before if Jr fails at HMS - he will take the blame - he's classy that way. And yes, he's classy in defending Teresa and I'm sure he and Taylor love one another. I don't think my opinion that letting her (likely) favorite step-brother (by the way, in my family we are all just brothers and sisters, I hope Jr. and Taylor feel the same way)....anyway, my opinion on the poor business decision by Teresa (whom I admire and respect) should have no effect on Taylor at school............is that hard to imagine?

Teresa and Taylor are fine people. No business should drop it's main asset for any reason...........and the crap with the #8 and the memorabilia (how is that spelled?) was just poor judgment - doesn't make anyone a bad person, it just wasn't very nice and will cost DEI $.........you know what comes next......don't you?

all i'm saying is:

DEI was worth more money (thus more to divide-up, though I don't recall Teresa handing-out any percentages) when Junior was there.

I hope I am wrong, but I think DEI is now worth quite a bit less (i.e., enough that 49% of it's previous value is more than 100% of it's current and future value).

But again, just my opinion - i hope I am wrong.

As far as my crystal ball goes see the above for why DEI folks would be fine with junior running the biz - However, I also think Junior is better-off not running the biz. He should do like Sr. - Drive for a smart owner, let them deal with the headaches, and start your own team - but don't drive for it.

Anon, do you have some insight as to why DEI folks would not be better-off with Junior as majority owner ? - Is teresa known as more generous than Junior - I ask because I don't know.............but I do think there will now be less $ at DEI, with which to be generous, than there would be with Junior still there.

I posted earlier just as a chance to have my say about the latest in this continuing saga and Mr. Poole's story was just the right bait.

I finally found and read some very good posts later. I particularly liked BudTeam73's, blunt but polite and in the end, pure and succinct - I too would like to see Jr and DEI do well because iI too am an Earnhardt fan......extremely well-put.

However Elena said was also blunt and made the point I wanted to make by my first post - ending with "You can chisel that in stone".

and MamaDew88's comment was particularly poignant.

Now, although I am a fan of canucks everywhere, I want to let canucken (whom I realize will likely never see this) rest easy and know that this area is for sounding-off on the NASCAR soap opera - I am attending to the more important matters mentioned by canucken over at a different blog called "Bush is a lying sociopath who should be impeached for war crimes dot com"

The subtitle of David Poole's blog is "some thoughts and observations..." and a blog is a narrative or diary by the person writing it. Therefore, this whole entity is basically a subjective view of the topic about which one writes. Observations may be considered objective, but are colored by the observer's subjective views. Also the reader interjects subjective views into what is seen on the page read. It is obvious to me that Mr. Poole thinks of Jr. as a spoiled brat who. upon not getting his way, "took a powder" which is a phrase that has negative connotations and that Theresa is the person Dale Sr. intended to be the caretaker of the business the two of them created. Perhaps this was not really what Mr. Poole meant, but that is the sentiment conveyed to me. The remark "duh" is definitely negative no matter how one looks at it. Regarding the absence of Jr. memorabilia at DEI during the luncheon goes, all we know is that it was not on display at that time although one person did say that it was missing before then. It is unfortunate that opinions cannot be expressed in a respectful manner, but when feelings about something are strong, it is difficult to express them with "milktoast" demeanor. If Mr. Poole does not want to endure demeaning comments about his person, he should be cognizant of the need to treat others with the same respect he would like directed toward himself. Meanwhile, I am sure that Dale Jr. will continue to make news, not only because his fans (of which there are many)demand it, but because it makes money for Mr. Poole and others, and we all know that the Almighty Dollar rules the world. If sacrifices are required to generate that dollar they will be made regardless of the damage done to individuals.

Does anyone think that when the all mighty Theresa passes that she will leave anything to her STEP children? The only one who will get it all will be Taylor. Does everyone think that Dale only loved one of his children? I don't believe that for a minute. When Jr wanted to buy 51% he said in an interview it was for Kelly, Kerry, Taylor and himself. That would be a 4 way split. Also mommy dearest could remarry and then get divorced and the hubby get half of everything. Jr didn't need to buy into DEI to make money he makes plenty of that himself(which he also stated) It was for his family. Who could fault him for trying for that - as only one child will end up with it all or maybe half and the other half to a future ex-husband and his kids. Now wouldn't that be sad?

Theresa not only made DEI what it is from a business development point of view but she created the prototype for individual personality licensing for a NASCAR driver. Like it or not, through my business dealings it is my understanding that she recognized that Dale was an icon and a viable licensing "property." Go back far enough and the only product you'll see is T-shirts, ball caps and bumper stickers for a driver. And most often it wasn't the driver or owner who did this but some sponsor like Coca-Cola or STP. You can say it was an easy decision but the fact is, she was the first to build and merchandise a business model and a diversified line of products around an individual. Even Michael Jordan did not do this, he made his fortune as a spokesperson.

WITH ALL DUE REPECT, Dale was not a great thinker or the kind of guy to sit behind a desk. Theresa was his partner, completely.

Before you call me names let me point out that I still think she should have given Jr. the 51% Compare the situation to any other sport and you'll see, he was the franchise and they will never recover the income flow and fan base they had with him driving.

My theory is RCR will eventually merge and then take over DEI at which time Jr will return and take back the number 8 or the number 3.

My theory is that Jr. is just being his classy self and trying to end the furor by being the bigger person, as usual. Time will tell, and I say the story will be that letting Junior go, being small about the #8, and purging the memorabilia (even if they backtracked and replaced some of it) will have combined to reduce their cash flow and fan base to the point where (as toyphd said) RCR or JR Motorsports has to buy-out DEI to save what is left.............then Junior will return to save the day (financially and spiritually) for the Earnhardts and Eurys and other friends and family.

Of course that will be after he has won 3 or more championships at HMS. He'll probably just run the 3 or 8 car for one last season to honor the Man and get the family company back on it's feet, so the legacy can continue.

Yep, that's what'll happen - accordin' to my crystal ball and all......y'all.....

So, relax, don't be skeeerd, and......

For the person who said Dale Jr. merch was gone the week after Homestead: I went to DEI on the first weekend of December and purchased a Dale Jr. mouse pad and a Dale Jr. 8 Bud pint glass. For the bargain basement price of a buck, as they had to get rid of his merch.

I think we people are missing is it would be tough to get Dale sr or JR fans to come to DEI which I have been at, with no record of Jr's acomplishments on the floor or on the wall!
Why would I go back to were it all started and see nothing of JR? The marketing end is bad for DEI, not just from fans but to court new sponsors as well these are facts!
I'm going to go to Hendricks to see things of my driver and buy my merchendise from them if I where to visit moorseville area again. I wouldn't have any need to go to DEI unless I wanted to connect with Dale SR, but after this split I don't see that happening for along time! I'm betting Dale sr is rolling in the grave over all this!
Sadly I'm willing to bet anyone this whole thing will play out for Dale jr and Hendricks far greater than DEI could have ever imagined! They should have gave Dalejr the 51% and T Earnhardt could have focued on what she really wants and that is Dale SR's legacy as a owner she will have a tough time ahead mark these words.

Second, Teresa, being The Great One's wife, HAD TO HAVE KNOWN, Dale's wishes for his children, ALL his children to continue on his legacy at DEI. She certainly cannot drive, can she?? The number 8 is the Earnhardt Family's number, it was Dale Sr.'s father, Ralph's #, and how DARE she steal this away from this family?! Just take a good look at the glare Momma Earnhardt gives Teresa at the HOFame (it's on youtube) ceremony. It is a none too kind one, and it is well deserved. Teresa proceeded to screw over every ONE of Dale's kids, but her own. She KNEW what he wanted done, and I bet that he felt she had it in her to follow through with his wishes! Sadly, she proceeded to do exactly opposite of what The Great One wanted. As another posted suggested, he is not rolling in his tomb, he is SPINNING! For her to do this to his family, including his brothers, sisters, and his mother, along with his kids, just shows what a true B she really is. I can specifically remember her backing away from Dale one time when he tried to hug her after a race, because, oh my, she was wearing a fancy schmancy white suit dress, and oh my, he had clutch dust on his uniform. DALE paid for the new face she has, I have photos of her prior to their money. Trust me, plastic surgeried B! New face, new teeth, fancy clothes, mink coats *shame, all paid for by DALE!! Again, everything Dale Sr. wanted done, she did opposite and then took up with one John Menard. Sorry, after being married to THe GREAT ONE, how could she be with Menard?? And indeed, DEI is now a ghost town, rented out for stupid A weddings! Just great...
